2023 QLD Rental Law Reforms: Minimum Housing Standards

Phase 3 of the law reforms are effective from September 1st 2023 for all new tenancies, including lease renewals & from September 1st 2024 for all tenancies.

Its aim is to raise the minimum housing standards & provide clarity around requirements and maintenance obligations for tenants and owners.

Minimum housing standards specify that rental properties must:

  1. The property must be weatherproof and structurally sound

  2. Have all included fixtures and fittings (including appliances) in good working order and not be likely to cause injury

  3. Have functioning locks or latches on all external doors and windows

  4. Be free from vermin, dampness and mould, however not if it's caused by the tenant

  5. Include privacy coverings on windows where it would be reasonable to expect it

  6. Have adequate plumbing and drainage and be connected to hot and cold drinkable water

  7. Have functioning and flushable toilets

  8. Have a functioning cook-top in kitchen where provided

  9. Have necessary fixtures for a laundry where provided

The minimum housing standards mark the final phase of a series of rental reforms that have been gradually implemented since October 2021.

It is essential to familiarise yourself with the requirements and take necessary measures to ensure compliance.
